CONDITIONS FOR USE OF THE BAZE SERVICE
The following terms and conditions apply to access of the BazeService (“the Service”) and by enrolling for this Service you will be deemed to have read, understood and accepted the same: -
- The Service
This Service is open to all Safaricom subscribers who wish to access live and on demand content on the Baze video portal brought to you by Comtec Integration Systems Limited, powered by Safaricom PLC.
- Eligibility
- This Service is available to Safaricom subscribers with a valid Safaricom mobile number. Minors may only use the Service with supervision of an adult.
- To use the Service, you must have an active subscription, which includes payment of Kshs. 10/= (Subscription with no data) or Kshs 20/= (Subscription with 200MB data) per day using Airtime/M-Pesa/Credit limit (for PostPay subscribers).
- Your subscription will automatically renew unless you unsubscribe by dialling *544*35#.
- Launch of Service
The Service will be available from 0000hours on 7th December 2020.
- How to Use the Service
- You can access the Service via your web browser using the URL: www.baze.co.ke and access plenty of local and international television shows, live shows, movies and series (“Content”) through smartphones and tablets.
- The Service does not automatically apply watershed rules. You acknowledge and accept that Comtec holds no responsibility for ensuring that where a minimum age recommendation is provided for Content, that Content is not viewed by persons under the minimum age. You further acknowledge and accept that parents should exercise their own parental control to ensure that any Content watched by their children is suitable. Comtec and its content partner’s rate content according to the Programming Code issued by the Communications Authority as well as our Editorial Policy. Baze Content rating serves as a protective measure to shield children from being exposed to inappropriate, offensive or harmful adult content. While the Service provides access to a range of content categories, certain content may be subject to age restrictions, contain strong language or other material which may offend sensitive viewers or be inappropriate for younger viewers. Comtec and its content service partners will attempt to provide appropriate audience guidelines relating to the Content, it is your responsibility of to heed those warnings and act responsibly.
- While a wide selection of Content is available to view via the Website, we may be required to block out specific content from time to time. This is due to third party content and studio license restrictions which may prohibit the Service from being utilized outside of any predetermined license period or Kenya.
- The Website requires an active Internet connection to access any content. Safaricom cannot guarantee the quality or stability of your Internet connection, and a poor or inconsistent Internet connection may impact on the quality of the content being presented through the Website.
- Subscription services have a daily, weekly, monthly term which starts after the expiry of the free trial period or any other date agreed between us.
- Free Trials
- Your Baze subscription will start with a free trial. The duration of the free trial is seven (7) days and is intended to allow new subscribers to try the Service. You are entitled to only one free trial.
- Free trial eligibility is determined by Safaricom at its sole discretion and we may limit eligibility or duration to prevent free trial abuse. We reserve the right to revoke the free trial and put your account on hold, in the event that we determine that you are not eligible. We may use information such as device ID and the mobile number used to determine eligibility. For combinations with other offers, restrictions may apply.
- We will charge the subscription fee at the end of the free trial period unless you cancel your subscription, prior to the end of the free trial period.
- Billing and cancellation
- Airtime billing
By accepting these terms and conditions, you authorise us to charge Kshs. 10/= for Subscription with no data or Kshs 20/= for Subscription with 200MB data, inclusive of local taxes for payment of your subscription fee. If a payment is not successfully deducted, due to insufficient funds, or otherwise, and you do not cancel your subscription, we may suspend your access to the Service until we have successfully charged the subscription fee.
- Cancellation of subscription
- You can cancel your Baze subscription at any time, and you will continue to have access to the Service through to the end of your billing period.
- To the extent permitted by the applicable law, payments are non-refundable, and we do not provide refunds or credits for any partial subscription’s periods or unwatched content.
- To cancel, go to *544*35# and select Baze for cancellation.
- You accept that your old profile and preferences will be retained for the duration as determined by Safaricom, for the purpose of audit trail, and to the extent required by law.
- Changes to the Price and Subscription Plans
We may change our subscription plan(s) and the price of our Service from time to time. However, any price changes or changes to your subscription plans will apply no earlier than thirty (30) days following notice to you.
- Other terms of use
- The Service and any Content viewed on the video portal are for your personal and non-commercial use only. With an active Baze subscription, we grant you a limited, non-exclusive, non-transferable right to access the Service and view Content. Except for the foregoing, no right, title or interest shall be transferred to you.
- The Content can be accessed from a desktop/laptop or mobile browser that supports Internet Explorer, Firefox, Chrome and Edge.
- The Service, including the Content library, is regularly updated. In addition, we continually test various aspects of our Service, including our website, user interfaces, promotional features and availability of Content. The functionality may change, and/or be removed, from time to time, without notice.
- The Service and its associated content is only available for consumption in Kenya.
- You agree to use the Service, including all features and functionalities associated therewith, in accordance with all applicable laws, rules and regulations, or other restrictions on use of the Service or content therein.
- You agree not to archive, reproduce, distribute, modify, display, perform, publish, license, create derivative works from, offer for sale, or use (except as explicitly authorized in these Terms of Use) Content and information contained on or obtained from or through the Service. You also agree not to: circumvent, remove, alter, deactivate, degrade or thwart any of the content protections in the Service; use any robot, spider, scraper or other automated means to access the Service; decompile, reverse engineer or disassemble any software or other products or processes accessible through the Service; insert any code or product or manipulate the content of the Service in any way; or use any data mining, data gathering or extraction method.
- In addition, you agree not to upload, post, email or otherwise send or transmit any material designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment associated with the Service, including any software viruses or any other computer code, files or programs. We may terminate or restrict your use of our Service if you violate these Terms of Use or are engaged in illegal or fraudulent use of the service.
- The quality of the display of the Content may vary from device to device, and may be affected by a variety of factors, such as your location, the bandwidth available and/or speed of your Internet connection. Default playback settings on mobile networks exclude HD, Ultra HD and HDR content. The minimum connection speed for SD quality is 0.5 Mbps; however, we recommend a faster connection for improved video quality.
- You are responsible for all Internet access charges. The time it takes to begin watching the Content will vary based on a number of factors, including your location, available bandwidth at the time, the content you have selected and the configuration of your Baze ready device.
- Baze Service is developed for Comtec and is designed to enable viewing of Content through any smartphone device or tablet that can access the web. This Service may vary by device and medium, and functionalities and features may also differ between devices.
- You acknowledge that the use of the Service may require third party content that is subject to third party licenses. You agree that you may automatically receive updated versions of the Baze Service and related third-party software.
- Warranties and liabilities
The Service is provided "as is" and without warranty or condition. In particular, our Service may not be uninterrupted or error-free. You waive all special, indirect and consequential damages against us. These terms will not limit any non-waivable warranties or consumer protection rights that you may be entitled to under the laws of Kenya.
- Applicable Law
These Terms shall be governed by and construed in accordance with the laws of Kenya.
- Privacy
- Definition
“Personal Information” means personal identifiable information as prescribed in the Data Protection Act which includes but is not limited to name, address, phone number, identification number, location data.
- Collection of information
We are required by law to collect certain personal information and are legally obligated to deny you the service if such information is not availed.
Apart from the legal obligation mentioned above, we also need to collect your Personal Information for quality service delivery. Please note that although this is voluntary, without such information we may not be able to provide quality service.
- Privacy
We are committed to respecting and protecting the privacy of the information we collect from you. Our privacy statement, as updated from time to time, explains how we treat your personal information, who we share your information with and measures taken protect your privacy when you use our Service. This can be found on Comtec Data Privacy Statement. If unable to access the link or our website, please reach us on any of our customer care channels to receive a copy.
- Minors
When registering a minor as a Safaricom subscriber, a person with parental authority shall open and maintain an account in their name for and on behalf of the minor. For purposes of these Terms and Conditions, a person with parental authority shall include the birth parents of a minor, legal guardian or other person who can demonstrate legitimate authority over the minor’s affairs.
- Extension of Terms
- Save as modified above, these Terms and Conditions are supplemental to and subject to the published Conditions of Use of the Safaricom Service Terms and Conditions, Safaricom PrePay and PostPay Data Bundles, Safaricom PrePay and PostPay Terms and other Services that you may be using.
- Comtec reserves the right to amend or vary these terms and conditions or to withdraw the Service at any time. In any of these events, notice will be given via media advertisements (including at Comtec’s discretion on the Baze website www.baze.co.ke) and will be effective immediately or as at the date referred in such notifications.
